By accessing or using the Site, you agree to be bound by the terms of this Agreement, including the Privacy Policy. This Agreement may be amended or updated by us from time to time without notice to you, and the revised terms will be effective when posted on the Site. Your continued use of the Site or Services after the posting of the revised Agreement constitutes your acceptance of the revised Agreement.
The Site and Services are provided on an “as is” and “as available” basis. SouthEast Edmonton Plumbers makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site. To the fullest extent permissible by applicable law, SouthEast Edmonton Plumbers disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SouthEast Edmonton Plumbers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Site or Services, whether based on contract, tort, strict liability, or otherwise, even if SouthEast Edmonton Plumbers has been advised of the possibility of such damages. In no event shall SouthEast Edmonton Plumbers’ total liability to you for all damages, losses, and causes of action arising out of or in connection with the Site or Services exceed the amount paid by you, if any, for accessing the Site or using the Services.
You agree to indemnify and hold SouthEast Edmonton Plumbers and its affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third-party.
SouthEast Edmonton Plumbers reserves the right to terminate your access to the Site and Services, without notice and in its sole discretion, for any reason or no reason, including, without limitation, a breach of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the province of Alberta, Canada, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the courts located in the province of Alberta, Canada, for the purpose of litigating all such claims or disputes.
This Agreement constitutes the entire agreement between you and SouthEast Edmonton Plumbers with respect to the Site and Services and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and SouthEast Edmonton Plumbers.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement and any rights and licenses granted hereunder may not be transferred or assigned by you but may be assigned by SouthEast Edmonton Plumbers without restriction.
The failure of SouthEast Edmonton Plumbers to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
